aes‘ efforts for our clients has resulted in over 50 of our clients receiving a release of liability letter issued from the Pennsylvania Department of Environmental Protection (PADEP) – effectively bringing closure to the environmental situation. The release of liability may be based on either statewide health standards or a site-specific standard, based on which approach is most advantageous for our client.

aes’ proven closure approach involves documenting the site-specific conditions and clearly identifying our client’s overall project goals for the site. The environmental evaluation and any subsequent remediation activities are conducted in distinct phases to optimize the investigation while controlling project costs. The technical work is guided by the DEP’s Pennsylvania Land Recycling Program Technical Guidance Manual, common industry standards such as those described by the American Society of Testing and Materials (ASTM) and the United States Environmental Protection Agency (USEPA), as well as years of experience working with a variety of sites, clients and regulatory agencies.

The environmental evaluation is only one aspect of the overall land recycling process. Since the release of liability for a site under Act 2 is based upon the present and future risk associated with the property, there are numerous remediation options for obtaining Act 2 Final Closure. Contamination may be left in place if remediation is impractical or excessively costly. aes works with our clients throughout the entire Act 2 process to ensure that the chosen remedy is not only in compliance with the legislation, but compatible with the client’s goals and limitations. Throughout this process aes personnel keep our clients informed of investigative activities, provide status updates, and constantly evaluate the data and the client’s goals to determine that the remediation strategy is the most beneficial solution for our client.
